122ai, LLC, a limited liability company organized under the laws of the State of Utah ("we," "our," or "us"), operates werkd. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.
Geographic Scope
werkd is offered only to residents of the United States and to businesses operating in the United States. We do not target, market to, or knowingly accept users located in the European Economic Area, the United Kingdom, or other regions outside the United States. If you are located outside the United States, please do not use the Service.
Information We Collect
Information you provide directly
- Account Information: Name, email, phone number, business details
- Customer Data: Names, addresses, phone numbers, and emails of your customers
- Job Information: Service details, schedules, notes, and photos
- Financial Data: Invoices, expenses, and payment information
- Media: Photos, receipts, and business logos
Information we collect automatically
- Device information and browser type
- Usage data and analytics collected through tools such as Vercel Analytics and Sentry
- IP address and approximate location
Voice Data
If you use voice input features, audio is processed by your browser's or device's built-in speech recognition (such as the Web Speech API). Depending on your browser or operating system, that audio may be transmitted to your browser or operating-system provider (for example, Google or Apple) for transcription. werkd does not record or store the audio on our servers; only the resulting text transcription is sent to our servers for processing.
Your Customer Data
When you add customer information, including names, phone numbers, addresses, or email addresses, to the Service, you represent and warrant that you have obtained any permissions, notices, or consents required to store, process, and use that information for service-related purposes, including appointment reminders, invoices, and messages you choose to send.

AI Improvement
Data Retention
We retain personal information for as long as reasonably necessary to provide the Service and for legitimate business purposes. Rather than fixed retention windows, we determine retention based on the following criteria:
- Active-account data (customer records, jobs, invoices, quotes, photos, receipts, expenses): retained for the duration of your active account, subject to our security and operational practices.
- Account data after cancellation: retained for a grace period of thirty (30) days after cancellation to allow you to export your data, after which it is deleted or de-identified, except where longer retention is required by law.
- Backups: retained for operational recovery and overwritten in the ordinary course of our backup rotation, which typically completes within 30 days. We do not actively process backup copies of deleted data, and personal information in backups is purged as backups age out.
- Legal, tax, fraud-prevention, and dispute-resolution records: retained for the periods required by applicable law or for as long as reasonably necessary to protect our rights and yours.

You may request earlier deletion of specific personal information by contacting privacy@werkd.pro, subject to legal and operational exceptions.
Information Sharing
We may share your information only in the following circumstances:
- With Your Customers: When you send invoices, notifications, or other communications through the Service
- With Service Providers: With third-party vendors who help us operate, host, secure, support, or improve the Service
- For Legal Reasons: When required by law, legal process, court order, or to protect the rights, property, or safety of 122ai, LLC, our users, or others
We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
SMS & Mobile Information
werkd does not send SMS messages — to your customers, to you, or to anyone else. werkd is not a messaging service and is not the sender of record for any text message. SMS-related features in the product are limited to drafting suggested message text and handing it off to your device's native messaging app for your manual review and send. Messages, if sent, originate from your phone number using your carrier; werkd does not transmit, store, or have access to the contents of those messages.
Account verification, billing notices, and security alerts are delivered via email or in-app notifications — not SMS. Phone numbers we collect from you are used for account contact only and are not shared with third parties or affiliates for marketing.
Third-Party Service Providers
We use third-party providers to operate aspects of werkd. These providers process only the data reasonably necessary for their services.
- Anthropic (Claude AI): AI-powered features such as job suggestions, smart invoicing, and AI receptionist tools. Data may include job descriptions, customer names, and business context.
- Stripe: Payment processing, including invoice amounts, billing details, and payment information.
- Clerk: Authentication and user account management.
- HERE Maps: Geocoding, routing, ETA calculations, and map services.
- Neon: Database hosting for application data.
- Cloudflare: Encrypted storage of database backups.
- Resend: Email delivery for invoices and notifications.
- Sentry: Error monitoring and performance tracking.
- Upstash: Rate limiting and caching.
- Vercel: Application hosting, content delivery, and analytics.
- QuickBooks / Xero: Optional accounting integrations, if you enable them.
Data Security
We use commercially reasonable administrative, technical, and organizational measures to help protect your information, including:
- Encryption in transit using HTTPS/TLS
- Encryption at rest through our infrastructure and database providers
- Secure authentication through Clerk
- Monitoring and logging tools to help detect errors and abuse
No method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security.
Your Rights
Subject to applicable law, you may have the right to:
- Access your personal data
- Correct inaccurate personal data
- Delete personal data
- Export your data in a portable format
- Opt out of certain non-essential communications

State-Specific Rights: Depending on your state of residence, you may have additional rights under the laws listed below. Where these laws apply, you may submit a verifiable request via privacy@werkd.pro. We do not sell personal information and we do not share it for cross-context behavioral advertising as those terms are defined under applicable state law.
- California (CCPA/CPRA): right to know, right to delete, right to correct, right to limit use of sensitive personal information, right to opt out of sale/sharing, and right to non-discrimination. California residents may also designate an authorized agent.
- Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana (MTCDPA), Iowa, Indiana, Tennessee, New Hampshire, New Jersey, Delaware, Maryland, Minnesota, Rhode Island, Nebraska, Kentucky: right to confirm whether we process your personal data, access, correct, delete, obtain a portable copy, and opt out of targeted advertising, sale of personal data, and profiling that produces legal or similarly significant effects.
- Nevada (SB 220): right to opt out of the sale of certain covered information.
Appeals: If we decline to act on your request, you may appeal by replying to our response or emailing privacy@werkd.pro with the subject “Privacy Appeal.” We will respond within 45 days (or the timeframe required by your state).
California Privacy Rights (CCPA/CPRA)
If you are a California resident, you may have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:
- Right to Know: Request information about the categories and specific pieces of personal information we collect, the sources of that information, the purposes for which it is used, and the categories of third parties to whom it is disclosed

We do not sell personal information.
Sensitive Personal Information
We may collect certain information that may be considered sensitive personal information under California law, such as payment-related information and account credentials. We use this information only as necessary to provide and secure the Service, process transactions, and comply with legal obligations. We do not use sensitive personal information to infer characteristics about you or for advertising purposes. Because we use sensitive personal information only for purposes permitted by CCPA Regulation § 7027(m), we are not required to offer a separate “Limit the Use of My Sensitive Personal Information” option.
Utah Privacy Rights (UCPA)
